Welcome to Guto: Gut Health & IBS (the "App"). These Terms and Conditions ("Terms") are a legally binding agreement between you ("you" or "user") and Guto ("we," "us," or "our"). By downloading, creating an account, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.
Apple App Store Acknowledgment: If you downloaded the App from the Apple App Store, you further acknowledge and agree that: (a) these Terms are between you and Guto only, and not with Apple; (b) Guto, not Apple, is solely responsible for the App and its content; (c) Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App; (d) Apple is not responsible for addressing any claims by you or any third party relating to the App; and (e) Apple and its subsidiaries are third-party beneficiaries of these Terms, and have the right to enforce these Terms against you.
THE APP AND ALL CONTENT, INCLUDING AI-GENERATED INSIGHTS, PREDICTIONS, GUT SCORES, AND SUGGESTIONS PROVIDED BY THE "GIBBY" CHARACTER, ARE FOR INFORMATIONAL, EDUCATIONAL, AND TRACKING PURPOSES ONLY.
GUTO IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. THE APP IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT FROM A QUALIFIED HEALTHCARE PROVIDER.
ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION OR BEFORE MAKING ANY CHANGES TO YOUR DIET, EXERCISE, OR HEALTH REGIMEN. RELIANCE ON ANY INFORMATION PROVIDED BY GUTO IS SOLELY AT YOUR OWN RISK.
Guto is a digital health companion that helps users track their diet, symptoms, and lifestyle factors. It uses an AI-powered engine to analyze this data, provide personalized insights, and generate predictive alerts, all delivered through an interactive interface featuring our character, Gibby.
You must be at least 18 years of age to create an account and use the App. By using the App, you represent and warrant that you are 18 or older and have the legal capacity to enter into this agreement.
Guto is a premium service, offered exclusively through paid subscriptions.
To use the App, you must create an account. You agree to:
You own the personal data, meal photos, and symptom logs you provide to the App ("User Content"). However, by using the App, you grant Guto a limited, non-exclusive, royalty-free, worldwide license to use, process, and analyze your User Content solely for the purpose of operating, providing, and improving the App's features (such as powering the AI and Gibby's insights).
All content and materials within the App, other than your User Content, including the Guto name, logo, the "Gibby" character (name, design, and animations), the App's user interface, source code, and all AI-generated content (excluding your personal data) are the exclusive intellectual property of Guto and its licensors. You may not use, copy, modify, or distribute any of our intellectual property without our prior written consent.
You agree not to do any of the following:
We reserve the right to suspend or terminate your account and access to the App, without notice or liability, if you breach these Terms.
You may terminate your account at any time by canceling your subscription and ceasing to use the App. To request full deletion of your account data, please contact us at our support email.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY GUT SCORES, PREDICTIONS, OR OTHER AI-GENERATED CONTENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL GUTO OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY CONTENT OR INSIGHTS PROVIDED BY THE APP; OR (C) ANY HEALTH-RELATED DECISIONS YOU MAKE BASED ON INFORMATION FROM THE APP.
These Terms shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.
We may modify these Terms at any time. We will notify you of any material changes by posting the new Terms within the App and updating the "Effective Date." Your continued use of the App after such changes constitutes your acceptance of the new Terms.
